FAIRNESS AND EFFICIENCY WORKING TOGETHER

THE IMPORTANCE OF LISTENING

MEDIATION SERVICES

Compared to arbitration where the arbitral panel renders a binding award, a party appointed mediator aims to guide the disputants towards an amicable resolution of their conflict. Thus, mediation is growing in its importance to the corporate sector due to its informal and confidential nature, potential low cost and effectiveness.

Leon Trakman studied mediation at Harvard Law School and was a founding member of the International Mediation Center, located in Dallas, Texas. He has taught widely on mediation and other dispute avoidance measures at a number of dispute resolution centers and universities, including at El Centro Jurici del ITESM, the World Trade Center in Monterrey, El Centro International de Mediacion, Centro de Resolucion de Controversias Mexico-Estados Unidos, Southern Methodist University, the University of California, Davis, Tulane University, Dalhousie University, and at the University of New South Wales.

He has mediated 26 major domestic and international disputes and has extensive experience in disputes on investment, maritime shipping, oil and gas, construction, computer technology and insurance.

If you are contemplating litigation, mediation may be a suitable alternative to resolve your dispute. Leon Trakman is able to assist all affected parties by exploring potential solutions that will avoid costly and prolonged court proceedings. He focuses on improving communication and enhancing understanding between the disputing parties and encourages them to actively participate in the dispute resolution process by finding common ground. Furthermore, Leon Trakman has worked with parties from different jurisdictions and cultures and understands the need to tailor mediation processes to reflect the priorities and considerations of parties involved in a dispute.
