While trade liberalization generally produces a net welfare, governments must provide appropriate legal reforms that will ensure that economic growth complies with national security, public policy, industrial and environmental standards.

In negotiating and drafting appropriate agreements with foreign governments and investors, states must consider a myriad of international obligations, applicable laws and standards. They also need to take into account their unique economic, cultural and legal priorities. It is important, too, for governments to ensure that these policy considerations are reflected in the final treaty or contract signed by the parties to such Agreements.

Leon Trakman has extensive experience in matters concerning liberalization of trade and investment and regularly provides consulting services to governmental agencies and institutions. He has been most recently involved in the debates surrounding Australia’s rejection of international investment arbitration in favor of domestic court litigation. He has also recently been consulted by governments and institutions in Mongolia, China and the Middle East on matters concerning FTA negotiations and dispute resolution over claims made by foreign investors.
